GERMAN: Reisebedingungen (AGB) für Yoga Retreats

Herzlich willkommen,

wir freuen uns, dass Sie sich für eines unserer Yoga Retreats entschieden haben. Unsere Retreats sollen Ihnen Raum geben, den Alltag hinter sich zu lassen, zur Ruhe zu kommen und sich ganz auf Yoga, Erholung und gemeinschaftliche Erlebnisse einzulassen. Damit Sie sich ganz auf Ihre Auszeit konzentrieren können, möchten wir auch die organisatorischen und rechtlichen Rahmenbedingungen transparent gestalten. Da wir unsere Yoga Retreats als Veranstalter von Pauschalreisen anbieten, gelten hierfür die gesetzlichen Vorschriften der §§ 651a ff. BGB.

Die nachfolgenden Reisebedingungen ergänzen diese gesetzlichen Bestimmungen und regeln die Einzelheiten unseres Vertragsverhältnisses. Sie dienen dazu, die gesetzlichen Regelungen zu konkretisieren, Rechte und Pflichten beider Vertragsparteien transparent darzustellen und einen verlässlichen Rahmen für die Durchführung unserer Retreats zu schaffen. Zwingende gesetzliche Vorschriften des Pauschalreiserechts bleiben hiervon unberührt.

Wir danken Ihnen für Ihr Vertrauen und freuen uns darauf, Sie auf Ihrem Yoga Retreat begleiten zu dürfen.

1. Vertragsschluss

1.1 Die Buchung eines Yoga Retreats erfolgt ausschließlich über die von der  HERSPACE GmbH –Schellingstraße 20, 80335 München, nachfolgend -Veranstalter- bereitgestellte Online-Buchungsplattform.

1.2 Die Darstellung der Yoga Retreats auf der Buchungsplattform stellt kein verbindliches Vertragsangebot dar, sondern eine Aufforderung an die Teilnehmerin, ein verbindliches Angebot zum Abschluss eines Reisevertrages abzugeben.

1.3 Mit Betätigung des Buttons „zahlungspflichtig buchen” oder einer entsprechend eindeutig beschrifteten Schaltfläche gibt die Teilnehmerin ein verbindliches Angebot zum Abschluss des Reisevertrages ab.

1.4 Der Reisevertrag kommt erst mit der ausdrücklichen Buchungsbestätigung des Veranstalters in Textform (z. B. per E-Mail) zustande. Die automatisch versandte Eingangsbestätigung stellt noch keine Annahme des Vertragsangebotes dar.

1.5 Für die angebotenen Yoga Retreats besteht gemäß § 312g Abs. 2 Nr. 9 BGB kein gesetzliches Widerrufsrecht, da es sich um Dienstleistungen im Zusammenhang mit Freizeitbetätigungen handelt, die für einen bestimmten Zeitraum erbracht werden. Es gelten ausschließlich die gesetzlichen Vorschriften des Pauschalreiserechts sowie die nachfolgenden Rücktrittsregelungen.

2. Zahlungsbedingungen

2.1 Mit Zugang der Buchungsbestätigung sowie Übergabe des gesetzlich vorgeschriebenen Reisepreissicherungsscheins wird eine Anzahlung in Höhe von 20 % des Reisepreises fällig.

2.2 Der Restreisepreis ist spätestens 30 Tage vor Reisebeginn ohne weitere Aufforderung zur Zahlung fällig, sofern nichts Abweichendes vereinbart wurde.

2.3 Gehen fällige Zahlungen trotz Mahnung und angemessener Fristsetzung nicht beim Veranstalter ein und hat die Teilnehmerin die Nichtzahlung zu vertreten, ist der Veranstalter berechtigt, vom Reisevertrag zurückzutreten.

2.4 Im Falle eines Rücktritts nach Ziffer 2.3 kann der Veranstalter die nach Ziffer 4 vorgesehenen Rücktrittskosten verlangen.

3. Leistungsänderungen vor Reisebeginn

3.1 Der Veranstalter ist berechtigt, nach Vertragsschluss geringfügige Änderungen einzelner Reiseleistungen vorzunehmen, soweit diese erforderlich werden, nicht wider Treu und Glauben herbeigeführt wurden und den Gesamtcharakter des Yoga Retreats nicht wesentlich beeinträchtigen.

3.2 Erhebliche Änderungen wesentlicher Reiseleistungen sind nur im Rahmen der gesetzlichen Vorschriften zulässig.

3.3 Die Teilnehmerin ist im Falle einer erheblichen Änderung einer wesentlichen Eigenschaft einer Reiseleistung oder der Abweichung von besonderen Vorgaben berechtigt in einer angemessenen Frist entweder die Änderung anzunehmen oder unentgeltlich vom Reisevertrag zurückzutreten oder die Teilnahme an einer Ersatzreise zu verlangen, wenn der Veranstalter eine solche Reise angeboten hat. Die Teilnehmerin hat die Wahl auf die Mitteilung zu reagieren oder nicht. Wenn die Teilnehmerin gegenüber dem Veranstalter nicht oder nicht innerhalb der gesetzlichen Frist reagiert, gilt die mitgeteilte Änderung als angenommen. Hierüber ist die Teilnehmerin in Zusammenhang mit der Änderungsmitteilung in klarer, verständlicher und hervorgehobener Weise zu informieren.

3.4 Eventuelle Gewährleistungsansprüche bleiben unberührt, soweit die geänderten Leistungen mit Mängeln behaftet sind. Hatte der Veranstalter für die Durchführung der geänderten Reise bzw. Ersatzreise bei gleichwertiger Beschaffenheit geringere Kosten, ist der Teilnehmerin der Differenzbetrag entsprechend § 651 m Abs. 2 BGB zu erstatten.

4. Rücktritt der Teilnehmerin vor Reisebeginn

4.1 Die Teilnehmerin kann jederzeit vor Reisebeginn vom Reisevertrag zurücktreten. Der Rücktritt ist in Textform in der Regel per Mail gegenüber dem Veranstalter zu erklären.

4.2 Bei Rücktritt vor Reisebeginn durch die Teilnehmerin oder tritt sie die Reise nicht an steht dem Veranstalter eine angemessene Entschädigung für die getroffenen Reisevorkehrungen und die Aufwendungen zu, soweit der Rücktritt nicht von dem Veranstalter zu vertreten ist oder am Bestimmungsort oder in dessen unmittelbare Nähe außergewöhnliche Umstände auftreten, die die Durchführung der Reise oder die Beförderung von Personen an den Bestimmungsort erheblich beeinträchtigen. Gemäß § 651 h Abs. 3 S. 2 BGB sind Umstände unvermeidbar und außergewöhnlich, wenn sie nicht in der Kontrolle des Reiseveranstalters unterliegen, und sich ihre Folgen auch dann nicht hätten vermeiden lassen, wenn alle zumutbaren Vorkehrungen getroffen worden wären. Die Höhe der Entschädigung bemisst sich nach dem Reisepreis abzüglich des Werts der ersparten Kosten des Veranstalters sowie abzüglich dessen, was dieser durch anderweitige Verwendung der Reiseleistung erwirbt. Die Entschädigung wird nach dem Zeitpunkt des Zugangs zur Rücktrittserklärung in einem prozentualen Verhältnis zum Reisepreis wie folgt berechnet: 

• bis 90 Tage vor Retreatbeginn: 25 %
• 89 bis 60 Tage vor Retreatbeginn: 50 %
• 59 bis 30 Tage vor Retreatbeginn: 65 %
• 29 bis 15 Tage vor Retreatbeginn: 80 %
• ab 14 Tage vor Retreatbeginn sowie bei Nichtantritt (No-Show): 90 %

4.3 Der Teilnehmerin bleibt der Nachweis vorbehalten, dass dem Veranstalter kein oder ein wesentlich geringerer Schaden entstanden ist.

Der Veranstalter empfiehlt den Abschluss einer Reiserücktrittskostenversicherung.

4.4 Der Veranstalter bleibt berechtigt, anstelle der Pauschalen eine konkret berechnete Entschädigung geltend zu machen, soweit er nachweist, dass ihm wesentlich höhere Aufwendungen als die jeweils anwendbare Pauschale entstanden sind. In diesem Fall ist der Veranstalter verpflichtet, die geforderte Entschädigung unter Berücksichtigung der ersparten Aufwendungen sowie abzüglich dessen, was er durch anderweitige Verwendung der Reiseleistung erwirbt, konkret zu beziffern und zu begründen.

4.5 Das gesetzliche Recht der Teilnehmerin, eine Ersatzperson nach § 651e BGB zu benennen, bleibt unberührt. Die Erklärung ist in jedem Fall rechtzeitig, wenn sie dem Veranstalter nicht später als 7  Tage vor Reisebeginn zugeht. Der Veranstalter kann dem Eintritt der Dritten widersprechen, wenn diese die vertraglichen Reiseerfordernisse nicht erfüllt. Tritt eine Ersatzteilnehmerin in den Vertrag ein, haften sie  und die ursprünglich Buchende  dem Veranstalter als Gesamtschuldner für den Reisepreis und die dadurch entstehenden Mehrkosten. Der Veranstalter darf eine Erstattung von Mehrkosten nur dann fordern, wenn und soweit diese angemessen und ihm tatsächlich entstanden sind. 

5. Rücktritt durch den Veranstalter

5.1 Der Veranstalter kann wegen Nichterreichens der Mindestteilnehmerzahl nur nach Maßgabe folgender Bestimmungen vom Reisevertrag zurücktreten: Die Mindestteilnehmerzahl wird in der Reiseausschreibung beziffert sowie der Zeitpunkt angegeben, bis zu welchem vor dem vertraglich vereinbarten Reisebeginn der Teilnehmerin spätestens die Erklärung zugegangen sein muss und in der Buchungsbestätigung wird die Mindestteilnehmerzahl sowie die späteste Rücktrittsfrist angegeben.

5.2 Der Rücktritt erfolgt unter Einhaltung der gesetzlichen Fristen, spätestens jedoch 20 Tage vor Reisebeginn bei Reisen von zwei bis sechs Tagen Dauer bzw. 30 Tage vor Reisebeginn bei Reisen mit einer Dauer von mehr als sechs Tagen.

5.3 Der Veranstalter ist verpflichtet, der Teilnehmerin gegenüber die Absage der Reise unverzüglich zu erklären, wenn feststeht, dass die Reise wegen Nichterreichen der Mindestteilnehmerzahl nicht durchgeführt wird. Sollte bereits zu einem früheren Zeitpunkt ersichtlich sein, dass die Mindestteilnehmerzahl nicht erreicht werden kann, hat der Veranstalter unverzüglich von seinem Rücktrittsrecht Gebrauch zu machen. Wird die Reise aus diesem Grund nicht durchgeführt, hat der Veranstalter unverzüglich, auf jeden Fall aber innerhalb von 14 Tagen nach dem Zugang der Rücktrittserklärung, Zahlungen der Teilnehmerin auf den Reisepreis zurückzuerstatten.

5.4 Das gesetzliche Rücktrittsrecht des Veranstalters wegen unvermeidbarer, außergewöhnlicher Umstände bleibt unberührt.

6. Reisemängel

6.1 Stellt die Teilnehmerin während des Yoga Retreats einen Reisemangel fest, hat sie diesen unverzüglich gegenüber der Retreatleitung oder dem Veranstalter anzuzeigen und Abhilfe zu verlangen.

6.2 Unterbleibt die Mängelanzeige schuldhaft, können Ansprüche insoweit ausgeschlossen sein, als dem Veranstalter dadurch die Möglichkeit zur Abhilfe genommen wurde.

6.3 Im Übrigen richten sich die Rechte der Teilnehmerin auf Abhilfe, Selbstabhilfe, Minderung, Kündigung sowie Schadensersatz nach den gesetzlichen Vorschriften der §§ 651i ff. BGB.

6.4 Wird der Aufenthalt infolge eines Mangels der in § 651 i Abs. 2 BGB bezeichneten Art erheblich beeinträchtigt, kann die Teilnehmerin den Vertrag nach § 651 l BGB kündigen. Die Kündigung ist erst zulässig, wenn der Veranstalter eine von der Teilnehmerin bestimmte angemessene Frist hat verstreichen lassen ohne Abhilfe zu leisten. Eine Fristsetzung entfällt, wenn Abhilfe unmöglich ist oder vom Veranstalter verweigert wird oder wenn die Kündigung des Vertrages durch ein besonderes Interesse der Teilnehmerin gerechtfertigt ist. 

7. Haftung

7.1 Die Haftung des Veranstalters richtet sich nach den gesetzlichen Vorschriften.

7.2 Soweit gesetzlich zulässig, ist die Haftung des Veranstalters für Schäden, die keine Körperschäden darstellen und nicht vorsätzlich oder grob fahrlässig verursacht wurden, auf den dreifachen Reisepreis beschränkt.

7.3 Für Leistungen, die als Fremdleistungen ausdrücklich gekennzeichnet und von Dritten eigenverantwortlich erbracht werden, haftet der Veranstalter nur im Rahmen der gesetzlichen Vorschriften.

8. Pass-, Visa- und Gesundheitsvorschriften

8.1 Der Veranstalter steht dafür ein, die Teilnehmerin  über allgemeine Bestimmungen von Pass-, Visa- und Gesundheitsvorschriften des Bestimmungslandes einschließlich der Fristen für die Erlangung von gegebenenfalls notwendigen Visa vor Vertragsabschluss sowie über deren eventuellen Änderungen vor Reiseantritt zu unterrichten. 

8.2 Die Teilnehmerin ist selbst dafür verantwortlich, die erforderlichen Reisedokumente mitzuführen, Visa rechtzeitig zu beantragen und gesundheitliche Voraussetzungen für die Reise zu erfüllen. Alle Nachteile, insbesondere die Zahlung von Rücktrittskosten, die aus der Nichtbefolgung dieser Vorschriften resultieren, gehen zu ihren Lasten, ausgenommen, wenn sie durch eine schuldhafte Falsch- oder Nichtinformation des Veranstalters bedingt sind.

9. Datenschutz

Personenbezogene Daten werden ausschließlich nach Maßgabe der Datenschutz-Grundverordnung (DSGVO) und des Bundesdatenschutzgesetzes verarbeitet. Einzelheiten ergeben sich aus der gesonderten Datenschutzerklärung des Veranstalters.

10. Streitbeilegung

Der Veranstalter ist weder verpflichtet noch bereit, an Streitbeilegungsverfahren vor einer Verbraucherschlichtungsstelle teilzunehmen, sofern sich aus zwingenden gesetzlichen Vorschriften nichts anderes ergibt. Sofern eine Verbraucherstreitbeilegung nach Drucklegung dieser Reisebedingungen für den Veranstalter verpflichtend würde, informiert er  die  Teilnehmerin hierüber in geeigneter Form.

11. Schlussbestimmungen

11.1 Für den Reisevertrag gilt das Recht der Bundesrepublik Deutschland, soweit dem keine zwingenden verbraucherschützenden Vorschriften entgegenstehen.

11.2 Sollten einzelne Bestimmungen dieser Reisebedingungen ganz oder teilweise unwirksam oder undurchführbar sein oder werden, bleibt die Wirksamkeit der übrigen Bestimmungen unberührt. An die Stelle der unwirksamen oder undurchführbaren Bestimmung treten die gesetzlichen Vorschriften.

Travel Terms and Conditions (GTC) for Yoga Retreats

This English version is a convenience translation. Only the German version of these travel terms and conditions is legally binding. In the event of any discrepancies between the German and the English version, the German version prevails.

We are delighted that you have chosen one of our yoga retreats. Our retreats are designed to give you space to leave everyday life behind, come to rest, and fully immerse yourself in yoga, relaxation, and shared experiences. So that you can focus entirely on your time away, we also want to make the organizational and legal framework transparent. As we offer our yoga retreats as an organizer of package tours, the statutory provisions of Sections 651a et seq. of the German Civil Code (BGB) apply.

The following travel terms and conditions supplement these statutory provisions and govern the details of our contractual relationship. Their purpose is to give concrete form to the statutory rules, to set out the rights and obligations of both contracting parties transparently, and to create a reliable framework for the delivery of our retreats. Mandatory statutory provisions of German package travel law remain unaffected.

1. Conclusion of Contract

1.1  Yoga retreats can be booked exclusively via the online booking platform provided by HERSPACE GmbH, Schellingstraße 20, 80799 Munich, Germany (hereinafter the “Organizer”).

1.2  The presentation of the yoga retreats on the booking platform does not constitute a binding contractual offer, but an invitation to the Participant to submit a binding offer to conclude a package travel contract.

1.3  By clicking the button labeled “book with obligation to pay” (or a button with equivalent unambiguous wording), the Participant submits a binding offer to conclude the package travel contract.

1.4  The package travel contract is concluded only upon the Organizer’s express booking confirmation in text form (e.g., by email). The automatically sent acknowledgment of receipt does not constitute acceptance of the contractual offer.

1.5  Pursuant to Section 312g (2) no. 9 BGB, there is no statutory right of withdrawal for the yoga retreats offered, as they are services related to leisure activities to be provided during a specific period. Solely the statutory provisions of package travel law and the following cancellation rules apply.

2. Payment Terms

2.1  Upon receipt of the booking confirmation and delivery of the statutorily required travel price security certificate (Sicherungsschein), a deposit of 20% of the travel price becomes due.

2.2  The remaining travel price is due for payment no later than 30 days before the start of the trip, without further request, unless otherwise agreed.

2.3  If payments due are not received by the Organizer despite a reminder and a reasonable grace period, and the Participant is responsible for the non-payment, the Organizer is entitled to withdraw from the package travel contract.

2.4  In the event of a withdrawal pursuant to clause 2.3, the Organizer may claim the cancellation charges provided for in clause 4.

3. Changes to Services Before the Start of the Trip

3.1  After conclusion of the contract, the Organizer is entitled to make insignificant changes to individual travel services, provided these changes become necessary, were not brought about contrary to good faith, and do not materially affect the overall character of the yoga retreat.

3.2  Significant changes to essential travel services are permitted only within the scope of the statutory provisions.

3.3  In the event of a significant change to an essential characteristic of a travel service or a deviation from the Participant’s special requirements, the Participant is entitled, within a reasonable period, either to accept the change, to withdraw from the package travel contract free of charge, or to request participation in a substitute trip, provided the Organizer has offered such a trip. The Participant may choose whether or not to respond to the notification. If the Participant does not respond to the Organizer, or does not respond within the statutory period, the notified change is deemed to have been accepted. The Participant must be informed of this in a clear, comprehensible, and prominent manner together with the notification of the change.

3.4  Any warranty claims remain unaffected insofar as the changed services are defective. If the Organizer incurred lower costs for carrying out the changed trip or a substitute trip of equivalent quality, the difference shall be refunded to the Participant in accordance with Section 651m (2) BGB.

4. Cancellation by the Participant Before the Start of the Trip

4.1  The Participant may withdraw from the package travel contract at any time before the start of the trip. The withdrawal must be declared to the Organizer in text form, usually by email.

4.2  If the Participant withdraws before the start of the trip or does not start the trip, the Organizer is entitled to reasonable compensation for the travel arrangements made and its expenses, unless the withdrawal is attributable to the Organizer or unavoidable, extraordinary circumstances occur at the destination or in its immediate vicinity that significantly affect the performance of the trip or the carriage of persons to the destination. Pursuant to Section 651h (3) sentence 2 BGB, circumstances are unavoidable and extraordinary if they are beyond the control of the Organizer and their consequences could not have been avoided even if all reasonable precautions had been taken. The amount of the compensation is determined by the travel price less the value of the costs saved by the Organizer and less what the Organizer earns through alternative use of the travel services. The compensation is calculated as a percentage of the travel price, depending on the time at which the withdrawal declaration is received, as follows:

• up to 90 days before the start of the retreat: 25%
• 89 to 60 days before the start of the retreat: 50%
• 59 to 30 days before the start of the retreat: 65%
• 29 to 15 days before the start of the retreat: 80%
• from 14 days before the start of the retreat, as well as in the event of a no-show: 90%

4.3  The Participant remains free to prove that the Organizer suffered no loss or a substantially lower loss. The Organizer recommends taking out travel cancellation insurance.

4.4  The Organizer remains entitled to claim individually calculated compensation instead of the flat rates, provided it proves that it incurred substantially higher expenses than the applicable flat rate. In this case, the Organizer is obliged to specifically quantify and substantiate the compensation claimed, taking into account the expenses saved and deducting what it earns through alternative use of the travel services.

4.5  The Participant’s statutory right to name a substitute person pursuant to Section 651e BGB remains unaffected. The declaration is in any event deemed timely if it reaches the Organizer no later than 7 days before the start of the trip. The Organizer may object to the entry of the third party if she does not meet the contractual travel requirements. If a substitute participant enters into the contract, she and the person who originally made the booking are jointly and severally liable to the Organizer for the travel price and any additional costs arising from the substitution. The Organizer may claim reimbursement of additional costs only if and to the extent that they are reasonable and were actually incurred.

5. Withdrawal by the Organizer

5.1  The Organizer may withdraw from the package travel contract due to failure to reach the minimum number of participants only in accordance with the following provisions: the minimum number of participants is stated in the trip description, together with the date by which the withdrawal declaration must have reached the Participant before the contractually agreed start of the trip, and the booking confirmation states the minimum number of participants and the latest withdrawal deadline.

5.2  The withdrawal must be declared in compliance with the statutory deadlines, at the latest, however, 20 days before the start of the trip for trips lasting between two and six days, and 30 days before the start of the trip for trips lasting more than six days.

5.3  The Organizer is obliged to notify the Participant of the cancellation of the trip without undue delay once it is certain that the trip will not take place because the minimum number of participants has not been reached. If it becomes apparent at an earlier point in time that the minimum number of participants cannot be reached, the Organizer must exercise its right of withdrawal without undue delay. If the trip does not take place for this reason, the Organizer must refund the Participant’s payments toward the travel price without undue delay, and in any event within 14 days of receipt of the withdrawal declaration.

5.4  The Organizer’s statutory right of withdrawal due to unavoidable, extraordinary circumstances remains unaffected.

6. Travel Defects

6.1  If the Participant discovers a travel defect during the yoga retreat, she must report it without undue delay to the retreat management or the Organizer and request that it be remedied.

6.2  If the defect is culpably not reported, claims may be excluded to the extent that the Organizer was thereby deprived of the opportunity to remedy the defect.

6.3  In all other respects, the Participant’s rights to remedy, self-remedy, price reduction, termination, and damages are governed by the statutory provisions of Sections 651i et seq. BGB.

6.4  If the stay is significantly impaired as a result of a defect of the kind described in Section 651i (2) BGB, the Participant may terminate the contract pursuant to Section 651l BGB. Termination is permitted only after the Organizer has allowed a reasonable period set by the Participant to expire without providing a remedy. Setting a deadline is not required if a remedy is impossible or is refused by the Organizer, or if termination of the contract is justified by a special interest of the Participant.

7. Liability

7.1  The Organizer’s liability is governed by the statutory provisions.

7.2  To the extent permitted by law, the Organizer’s liability for damages that do not constitute bodily injury and were not caused intentionally or through gross negligence is limited to three times the travel price.

7.3  For services that are expressly identified as third-party services and are provided by third parties on their own responsibility, the Organizer is liable only within the scope of the statutory provisions.

8. Passport, Visa, and Health Requirements

8.1  The Organizer undertakes to inform the Participant, before the conclusion of the contract, about the general passport, visa, and health requirements of the destination country, including the deadlines for obtaining any necessary visas, and to inform her of any changes to these requirements before the start of the trip.

8.2  The Participant is responsible for carrying the required travel documents, applying for visas in good time, and meeting the health requirements for the trip. Any disadvantages resulting from non-compliance with these requirements, in particular the payment of cancellation charges, shall be borne by the Participant, unless they are caused by culpable misinformation or a culpable failure to inform on the part of the Organizer.

9. Data Protection

Personal data is processed exclusively in accordance with the General Data Protection Regulation (GDPR) and the German Federal Data Protection Act (BDSG). Details are set out in the Organizer’s separate privacy policy.

10. Dispute Resolution

The Organizer is neither obliged nor willing to participate in dispute resolution proceedings before a consumer arbitration board, unless mandatory statutory provisions provide otherwise. Should consumer dispute resolution become mandatory for the Organizer after these travel terms and conditions were finalized, the Organizer will inform the Participant in an appropriate manner.

11. Final Provisions

11.1  The package travel contract is governed by the law of the Federal Republic of Germany, unless mandatory consumer protection provisions provide otherwise.

11.2  Should individual provisions of these travel terms and conditions be or become wholly or partially invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. The invalid or unenforceable provision shall be replaced by the statutory provisions.
